Terms of Service

1. Acceptance of Terms

By engaging Cultura Consulting Services ("Company," "we," "our," or "us") for tax preparation, immigration consulting, or any other services, you ("Client," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all services provided by Cultura Consulting Services, including but not limited to tax preparation, immigration form assistance, consultations, and any related services.

2. Services Provided

Tax Services

As an IRS Enrolled Agent, we provide:

• Individual and business tax return preparation
• Tax planning and consultation
• IRS representation and audit assistance
• ITIN applications
• Amended returns and prior year filings

Immigration Services

As a California Registered Immigration Consultant, we provide:

• Immigration form preparation and filing assistance
• Document translation services
• Consultation on immigration processes
• Assistance with USCIS correspondence

3. Client Responsibilities

As our client, you agree to:

1. Provide accurate, complete, and timely information
2. Respond promptly to requests for documentation
3. Review all prepared documents before signing
4. Notify us of any changes in your circumstances
5. Pay all fees in accordance with our fee schedule
6. Maintain copies of all documents for your records
7. Comply with all tax laws and immigration regulations

4. Fees and Payment

Fee Structure

• Fees are based on the complexity of services provided
• Government filing fees are separate and non-refundable
• Payment is due upon completion of services unless otherwise agreed
• Consultation fees are due at the time of consultation

Payment Methods

We accept cash, check, money order, and major credit cards. A processing fee may apply for credit card payments.

Refund Policy

Service fees are generally non-refundable once work has begun. Government fees are never refundable. Refunds may be considered on a case-by-case basis at our sole discretion.

5. Confidentiality

We maintain strict confidentiality of all client information in accordance with:

• IRS Circular 230 requirements
• California Immigration Consultant regulations
• Applicable privacy laws and regulations

We will not disclose your information without your consent, except as required by law or government agencies.

6. Limitations of Liability

While we strive to provide accurate and timely services:

• We are not responsible for delays or denials by government agencies
• We cannot guarantee specific outcomes for tax or immigration matters
• Our liability is limited to the fees paid for services
• We are not liable for penalties or interest resulting from client-provided incorrect information

7. Document Retention

We retain client documents according to legal requirements:

• Tax documents: Minimum of 7 years
• Immigration documents: As required by California regulations
• Electronic copies may be maintained indefinitely

Clients are responsible for maintaining their own copies of all documents.

8. Electronic Communications

By providing your email address, you consent to receive electronic communications from us. While we use reasonable security measures, electronic communications are not always secure. You acknowledge the risks of electronic communication.

9. Termination of Services

Either party may terminate services at any time. Upon termination:

• Client must pay for all services rendered to date
• We will return original client documents
• Work product remains our property unless fully paid
• Termination does not relieve payment obligations

10. Dispute Resolution

Any disputes arising from these terms or our services shall be:

1. First attempted to be resolved through good faith negotiation
2. If negotiation fails, resolved through binding arbitration in San Diego County
3. Governed by California law

11. Indemnification

You agree to indemnify and hold harmless Cultura Consulting Services, its employees, and agents from any claims, damages, or expenses arising from:

• Your provision of false or incomplete information
• Your failure to comply with tax laws or immigration regulations
• Your unauthorized use of our work product

12. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

13. Modifications

We reserve the right to modify these terms at any time. Continued use of our services after modifications constitutes acceptance of the updated terms.
